Our client, Mr. D was charged with possessing indecent images after his devices were seized when the police searched the entire apartment building that he lived in. After a lengthy investigation, our lawyers were able to prove that the images were wrongfully categorised by the police, and had been on his phone due to pop-up malware that he was completely unaware about. Faced with the facts, the prosecution were forced to drop all charges, thus restoring our client’s freedom.

Mr D and the rest of the tenants at his building had their privacy invaded when the police conducted a raid on the entire apartment building, armed with a warrant. After all the flats were searched and all mobile devices were seized, the police arrested Mr. D and his neighbour for possession of indecent images. The charges were later updated to making indecent images, a much more serious offence.

Fearful for his reputation and determined to clear his name, he contacted us to represent him. Our criminal defence solicitors immediately sprang into action, to uncover the whole picture. After meticulously analysing all evidence submitted by the police and the prosecution, our criminal defence solicitors conducted their own thorough legal investigation. This included hiring our own forensic experts to analyse our client’s mobile devices (including his phone and his laptop), gathering witness statements from other affected members within the block of flats, and character statements from our client’s friends, family members, and neighbours.

During the investigation, the forensic reports revealed that the police had wrongfully categorised the images present on our client’s mobile devices, and did not reveal the source of the images. Though the police claimed that they were indecent images of children, in reality the people within the images were adults. Furthermore, the images were downloaded onto our client’s device due to a virus on his device, and he had no knowledge at all about the malware on his device, or the images that were downloaded.

Before the trial even began, our defence lawyers submitted overwhelming evidence that proved our client’s innocence – from the crucial mistakes made by the police to the fact that our client had no idea these images were present on his device. Our forensic reports proved that our client did not willingly download these images at all, and were downloaded due to a virus on his mobile device.
Faced with the facts, the prosecution realised that there was no case to argue, and our client was wholly innocent. Thus, the prosecution was forced to drop all charges against him; thanks to a thorough defence and a lengthy investigation, our client was successfully cleared of all charges and was able to return to his life.
