Our client, accused of dangerous driving that caused one death and serious injury, faced a potential 10-year-plus prison sentence. Stuart Miller Solicitors uncovered key evidence, challenging the prosecution's claims, leading to a not guilty verdict on all charges.

Our client was accused of dangerous driving that tragically resulted in the death of one person and serious injury to another. This devastating incident could have led to a severe 10-year-plus prison sentence if our client were found guilty. The collision occurred while our client was driving towards Oxfordshire, when he lost control of his vehicle, swerving into the left lane and causing the accident. Facing such serious charges, our client turned to Stuart Miller Solicitors and our experienced defence solicitors for a robust and effective defence.

When our client first contacted us, our experienced defence solicitors immediately reviewed the evidence the prosecution had presented. We advised our client to give “no comment” during the police interview after thoroughly assessing the situation. We also found it troubling that the police refused to show the CCTV footage before the interview. As the case progressed, our client was charged, and phone records showed that he had used his mobile phone while driving. Additionally, witness statements were all pointing towards dangerous driving, which made the case more challenging.

To strengthen our defence, Stuart Miller Solicitors instructed independent experts to investigate whether any mechanical faults or road conditions contributed to the crash. Our experienced defence solicitors, Abu Kibla and Sophie Slaney, took it upon themselves to visit the scene of the accident. Upon investigation, they found that the road’s layout suggested it was highly unlikely our client’s vehicle could have swerved in the way described unless there had been a mechanical fault. This raised significant doubts about the dangerous driving allegations and the prosecution’s claims.

We also disputed the accusation that our client had been holding his mobile phone while driving. The prosecution argued that our client was using his handset, but our defence lawyers provided evidence that his phone was mounted on a magnetic holder attached to the dashboard. We even showed video footage demonstrating that our client always used the phone holder while driving, which further doubted the dangerous driving claims.

The trial lasted a week, and despite the weight of the evidence against our client, the defence lawyers at Stuart Miller Solicitors implemented an effective defence strategy that uncovered inconsistencies in the prosecution’s case. Thanks to our thorough investigation and strong arguments, the jury returned a verdict of not guilty on both charges of dangerous driving and causing serious injury.
