Our client was wrongfully convicted of assault by beating, and sentenced to prison. During the appeal, our lawyers successfully argued for his innocence, resulting in all charges being dropped for this offence, and for a future not guilty verdict for a related offence of witness intimidation.

Mr. W was arrested and charged for assault by beating after his sister, Ms W, alleged that he assaulted her when she went to visit him, bringing her child and nephew. After calling the police, he was arrested and refused bail, and was forced to spend time in custody.

When Mr. W contacted us, our defence solicitors immediately sprang into action, ready to uncover the truth of this case. They immediately followed up with the prosecution and the police, to meticulously analyse any and all evidence gathered for the case. Our assault lawyers worked with potential witnesses and with the client, and established the fact that our client did not assault his sister in any way, and was shocked at his arrest because what seemed like a trivial family argument escalated into a false criminal charge.

During the trial, the judge wrongfully convicted our client, making a grave error in interpreting the facts of the case. Immediately, our assault lawyers launched an appeal in the Crown Court, to ensure our client faced justice. During the appeal, our defence lawyers shockingly discovered that a key witness – their mother – was not allowed to give evidence to the Magistrate’s Court. This was an immense abuse of process, and directly resulted in our client being wrongfully convicted. The mother’s testimony – where she clarified that our client did not assault or hurt his sister in any way – along with our rigorous cross-examination of the prosecution, resulted in the judge approving the appeal, and immediately acquitting our client.

Furthermore, this influenced a related case – our client was also wrongfully charged with witness intimidation and damage to property, as his sister falsely claimed that he attempted to intimidate her. By proving his innocence, the judge dropped all related charges, effectively acquitting our client of all malicious offences, alleged by his own sister.
