Confiscation Proceedings

Confiscation Proceedings in a nutshell

Once someone is convicted of a Criminal Offence from which they can be shown to have benefitted financially, the Proceeds of Crime Act 2002 allows the prosecution to seek a Confiscation Order and invariably, they do. They calculate how much the defendant has benefitted from his or her conduct and what assets he or she has available to repay that benefit. The Court then Orders the defendant to pay this sum immediately or serve a term of imprisonment for non-payment. A 3 month grace period is usually allowed to make arrangements to pay the sum but if the defendant has failed to pay and is imprisoned, the debt remains nevertheless remains outstanding!
