How is the offence of fraud by false representation defined?

Fraud by false representation cases actually fall under the wider offence known as ‘general fraud’. The law on general fraud is found primarily in the Fraud Act 2006, which states that there are three ways to commit general fraud:

  1. that the defendant’s conduct was dishonest, and
  2. that the defendant’s intention was to make a gain or cause a loss or the risk of loss to another

What is the maximum sentence for fraud by false representation?

The maximum sentence for fraud by false representation is 12 months’ imprisonment and an unlimited fine in the magistrate’s court, and 10 years’ imprisonment and an unlimited fine in the Crown Court.
